User Agreement
These terms govern every lease entered into through ZeroLease. By paying the token amount, completing KYC, and signing via OTP, you agree to be bound by all clauses below. Electronic signatures via OTP are legally binding under the Information Technology Act, 2000 and the Indian Contract Act, 1872.
1. Nature of the Platform & Role of ZeroLease
ZeroLease is a technology and services platform operated by Avenaa Hospitality Management Pvt Ltd. It facilitates monthly leases between independent vehicle Owners and Users. The lease is between the User and the Owner; ZeroLease provides KYC, payments, dispute resolution, GPS, maintenance coordination and support.
2. Eligibility & KYC
User must be 21+, hold a valid Indian driving licence, and complete KYC with Aadhaar, PAN and DL. Misrepresentation voids the lease and may invite legal action.
3. Lease Term, Rent & Platform Fee
Lease is on a rolling monthly basis from the Handover Date. Monthly Rent is payable in advance via the Platform. A 5% platform fee is added to every customer transaction; 5% is deducted from owner payouts. Token (10% of monthly rent) is paid to lock the car.
4. Security & Zero-Deposit Liability
No traditional security deposit is collected. The User remains directly liable for damages, fines, traffic challans, recovery costs and any unpaid dues. ZeroLease may recover such amounts from the User by all lawful means.
5. Vehicle Handover & Inspection
Joint digital inspection at handover and return. Odometer, fuel level, existing damages and documents (RC/Insurance/PUC) are recorded. User accepts the vehicle in the recorded condition.
6. User Responsibilities & Maintenance
User must drive lawfully and carefully, follow scheduled servicing at ZeroLease-authorised centres, and report mechanical issues immediately. Routine consumables (fuel, oil top-up, washer fluid) are User's responsibility.
7. Fuel, Tolls, Challans & Traffic Violations
User is solely responsible for all tolls, parking fees, and traffic challans during the lease. Challans must be cleared within 7 days of issuance/notification. Failure triggers immediate vehicle repossession and forfeiture of the current month's rent.
8. Insurance, Accidents & Damage
Vehicle is covered by Owner's insurance. User must report accidents to ZeroLease and the police immediately. User is liable for insurance deductible, uninsured costs, and 100% of costs if at fault, negligent, under the influence, or in breach of this agreement.
9. Prohibited Use
Use for racing, off-roading, ride-sharing/commercial taxi, driving instruction, sub-letting, smuggling, illegal transport, or any unlawful activity is strictly prohibited and constitutes immediate material breach.
10. Geographic Restrictions
Vehicle must remain within India. Travel to restricted/border or no-go areas requires prior written approval. Relocation between cities must be informed in writing.
11. Recovery, Repossession & Termination
ZeroLease may immediately repossess the vehicle on material breach including non-payment, prohibited use, or unpaid challans beyond 7 days, without refund of the current month's rent. The User may terminate with 15 days' written notice.
12. Late Payment & Default
Monthly Rent overdue incurs a late fee of Rs.200/day from the due date. Repeated default may result in immediate termination and recovery action.
13. Return & Closure
Vehicle to be returned with same fuel level, all documents intact, no new damage beyond fair wear. Shortfall in fuel or damage will be charged with service fees.
14. Limitation of Liability & Indemnity
User indemnifies ZeroLease and the Owner against all claims arising from User's acts/omissions. Platform liability is limited to fees actually collected from the User in the preceding 1 month.
15. Data, Privacy & Communications
User consents to processing of personal & KYC data, GPS telemetry, and platform communications (SMS/email/WhatsApp). Refer to the Privacy Policy on zerolease.co.in.
16. Dispute Resolution & Governing Law
Governed by the laws of India. Disputes first attempted by mediation; failing which arbitration under the Arbitration & Conciliation Act, 1996. Courts at Indore, Madhya Pradesh have exclusive jurisdiction.
17. General Provisions
This Agreement, together with the booking confirmation and Platform Policies, constitutes the entire agreement. Electronic signatures via OTP are legally binding under the Information Technology Act, 2000 and the Indian Contract Act, 1872.
When you lease a car through ZeroLease, you sign this agreement electronically via OTP after KYC approval. The signed copy is stored on your account and emailed to you with a unique signature reference (e.g. ZL-XXXXXXXX-YYYYMMDD…). You can download a PDF of your signed agreement anytime from your Lease detail page.
